Medical, Dental & Veterinary Staff

The Fair Labor Standards Act (“FLSA”) requires certain employers to pay their employees overtime compensation for all hours worked in excess of forty in a workweek at a rate not less than one and one-half times their regular rate of pay. Employees are generally assumed to be entitled to the rights and protections of the FLSA unless the employer is able to establish that such employees are not covered by the act because the employee fits within one of the several statutory exemptions.

Many employees in doctor, dental and veterinary offices are extremely busy and often work long hours without being paid proper overtime wages. Oftentimes, employees in this industry are given job titles that many assume are not entitled to overtime pay, such as physician’s assistant, account manager, veterinary technician or billing specialist. You may be paid a salary, but labor laws for salaried employees may still require your employer to pay overtime wages when you work more than forty hours in a workweek.
