The Fair Labor Standards Act (“FLSA”) requires certain employers to pay their employees overtime compensation for all hours worked in excess of forty in a workweek at a rate not less than one and one-half times their regular rate of pay. Employees are generally assumed to be entitled to the rights and protections of the FLSA unless the employer is able to establish that such employees are not covered by the act because the employee fits within one of the several statutory exemptions.

Landscapers and Maintenance Workers are often improperly paid when employers fail to pay overtime wages for all overtime hours worked, only pay straight time, pay a day rate, or when meal or personal breaks are automatically deducted from their compensation. Also, employees who travel from job site to job site throughout the day must generally be paid for the travel time between sites. Such employees generally are entitled to overtime pay even when paid on a salary or some other fixed amount of regular compensation.
